Die ICONS Activities S.L. ist als Diensteanbieter nach \u00a7 3 Nr.1, \u00a7 8 (1) des Teledienstegesetzes (TDG) (Stand 14.12.2001) f\u00fcr eigene Informationen, die zur Nutzung bereitgehalten werden, nach den allgemeinen Gesetzen verantwortlich.<\/p>\n

Von diesen eigenen Inhalten sind Querverweise („Links“) auf die von anderen Anbietern bereitgehaltenen Inhalte zu unterscheiden. Bei den \u00fcber „Links“ \u00fcbermittelten oder gespeicherten Inhalten anderer Anbieter handelt es sich um fremde Informationen und nicht um eigene Inhalte von ICONS Activities S.L. Bei „Links“ handelt es sich jedoch immer um „lebende“ (dynamische) Verweise. ICONS Activities S.L. hat bei der erstmaligen Verkn\u00fcpfung zwar den fremden Inhalt daraufhin \u00fcberpr\u00fcft, ob durch ihn eine m\u00f6gliche zivilrechtliche oder strafrechtliche Verantwortlichkeit ausgel\u00f6st wird. Nach dem TDG ist die ICONS Activities S.L. als Diensteanbieter jedoch nicht verpflichtet, die von ihr \u00fcbermittelten oder gespeicherten fremden Informationen zu \u00fcberwachen oder nach Umst\u00e4nden zu forschen, die auf eine rechtswidrige T\u00e4tigkeit hinweisen (\u00a7 8 Abs. 2 TDG). Erst wenn festgestellt oder von anderen darauf hingewiesen wird, dass ein konkretes Angebot, zu dem ein Link bereitgestellt wurde, eine zivil- oder strafrechtliche Verantwortlichkeit ausl\u00f6st, wird der Verweis auf dieses Angebot aufgehoben. Im Einzelnen regelt das TDG die Haftung des Diensteanbieters wie folgt:<\/p>\n

ICONS Activities S.L. ist nicht verantwortlich f\u00fcr die \u00dcbertragung von externen Informationen, wenn ICONS Activities S.L.<\/p>\n

  1. dies nicht initiiert hat,<\/li>\n
  2. die Adressdaten der \u00fcbermittelten Informationen nicht ausgew\u00e4hlt hat und<\/li>\n
  3. die \u00fcbermittelten Informationen nicht ausgew\u00e4hlt oder ver\u00e4ndert hat (\u00a7 9(1) TDG)<\/li>\n<\/ol>\n

    ICONS Activities S.L. ist nicht verantwortlich f\u00fcr die automatische, vor\u00fcbergehende Zwischenspeicherung von Informationen Dritter, wenn diese<\/p>\n

      \n
    1. die Informationen nicht \u00e4ndert,<\/li>\n
    2. die Bedingungen f\u00fcr den Zugang zu den Informationen einh\u00e4lt,<\/li>\n
    3. die Regeln f\u00fcr die Aktualisierung der Informationen einh\u00e4lt, die in weithin anerkannten und verwendeten Industriestandards festgelegt sind,<\/li>\n
    4. nicht mit dem zul\u00e4ssigen Einsatz von Technologien zur Erfassung von Daten \u00fcber die Nutzung der Informationen gem\u00e4\u00df weithin anerkannten und verwendeten Industriestandards kollidiert; und<\/li>\n
    5. unverz\u00fcglich t\u00e4tig wird, um gespeicherte Informationen zu entfernen oder den Zugang zu ihnen zu sperren, sobald sie Kenntnis davon erlangt, dass die Informationen am urspr\u00fcnglichen \u00dcbermittlungsort aus dem Netz entfernt worden sind oder der Zugang zu ihnen gesperrt wurde oder ein Gericht oder eine Verwaltungsbeh\u00f6rde die Entfernung oder Sperrung angeordnet hat (\u00a7 10 TDG).<\/li>\n<\/ol>\n

      ICONS Activities S.L. ist nicht verantwortlich f\u00fcr Informationen Dritter, die sie f\u00fcr einen Nutzer speichert, vorausgesetzt, dass sie<\/p>\n

        \n
      1. keine Kenntnis von der rechtswidrigen Handlung oder Information hat und im Falle von Schadensersatzanspr\u00fcchen keine Kenntnis von Tatsachen oder Umst\u00e4nden hat, aus denen sich die rechtswidrige Handlung oder Information ergibt, oder<\/li>\n
      2. unverz\u00fcglich t\u00e4tig geworden ist, um die Information zu entfernen oder den Zugang zu ihr zu sperren, sobald sie davon Kenntnis erlangt hat (\u00a7 11 TDG).<\/li>\n<\/ol>\n
